Free Eye Camp doctors Arrested

Two ophthalmologists have been arrested after 2 years of having conducted a Free cataract removal surgery camp in this Charitable Hospital. Were the botched up surgeries because of professional incompetence or due to infection is unknown. The Management of such Charitable Hospitals are responsible for providing basic infrastructure including autoclaving facilities and OT sterility. However it is so much more easy and attractive to prosecute the doctors to satisfy the urge for retribution.
Does one have to do these “Free Medical Camps”. The Rotary Clubs, The lion Clubs, the socio religious organizations who garner all the benefits of such camps do not rise up in defence of the doctors nor are ever accused of misconduct. Are these only to be feted and the responsibility of any mishap laid squarely on the shoulders of the doctors.
I have heard this ad nauseum that doctors are commercial and that is the reason for increased litigation. In this case where is the “mens rea” or guilty mind which is so loftily espoused by the judiciary. This here is a classic example of private doctors and individuals providing services free of cost to public which should ideally be provided by the Government but are now being prosecuted as a criminal even though this was a free camp.
At least the Max and Fortis hospitals charge their pound of flesh to provide services and so if once in a while they are penalized for an error it could be understandable. What is the justification here? To be prosecuted as a criminal for doing charity can happen only in India and should be a lesson to all those within the profession who are proponents of compassion and charity by doctors as panacea for all ills ailing the profession.
